Dewi Evans isn’t shy about his role in the conviction of Lucy Letby. After offering his services to the police in May 2017, the retired pediatrician claims it took him 10 minutes to work out that murder had taken place at the Countess of Chester Hospital. The rest, as they say, is history. It was Evans’s analysis that led to a damning chart being shown at Letby’s 10-month trial three years ago, supposedly demonstrating that she had been present whenever a baby died or collapsed in suspicious circumstances at the hospital’s neonatal unit between June 2015 and June 2016.

But did the chart tell the whole story?

Today, I can reveal evidence that casts fresh doubt. Derived from unpublished notes taken by a police officer at the time, it shows that, when Evans first detailed his findings to senior detectives from Cheshire Police and National Crime Agency experts over two days in October 2017, a number of his conclusions were strikingly different from those presented in court. And yet, the jury was never told about them.

Some of the discrepancies were relatively minor. For example, during Letby’s trial, the court was told by one of her colleagues that the health of a victim known as “Baby K” began to deteriorate after Letby deliberately dislodged her breathing tube. Reviewing the evidence in 2017, however, Evans originally told the police he believed Baby K died from natural causes and had “no suspicions” about the case. She had been born prematurely and simply “deteriorated”. In an earlier email to police, he pointed out that the health of such infants was often “unstable”. Letby was convicted of attempting to murder Baby K after a retrial last year, after the first jury could not reach a verdict on her case.

Other discrepancies contained within the official notes, written by Detective Sergeant Jane Moore, are more serious. In fact, according to Evans’s initial analysis, and as the below chart illustrates, Letby was not in the hospital when 10 of the 28 incidents he described as “suspicious” took place — more than a third of them. In other words, if Evans’s initial analysis suggested there had been multiple murders, Letby could not have committed all of them.

The inconsistencies began with the very first case — that of “Baby A”, who died on 8 June 2015, supposedly from having air injected into his stomach. The jury convicted Letby of murdering him after hearing that, after being born nine weeks premature, his condition deteriorated after Letby came on shift at 7.30pm. According to Moore’s meeting notes, however, Evans regarded the entire period after 5pm as “relevant” — i.e. the baby could have started to deteriorate before Letby arrived.

Another case Evans thought “suspicious” was that of Baby A’s twin, “Baby B”. The trial was told she collapsed and almost died at about 12.30am on 10 June, when Letby was on duty, and the nurse was later convicted of attempted murder. But when Evans met the police in 2017, he suggested the child had been subjected to a further attack on 19 June, when at 10.50pm she was either injected with “intravenous air” or smothered by a “hand over [her] face”. Evans said the police should focus their inquiries on the period that started at 9.30pm. However, nothing was said about this second incident at Letby’s trial, probably because she clocked off that day at 8pm.

The next child Letby was convicted of murdering was “Baby C”. It is already known that Evans altered his account of his death at the trial. He had claimed in a report written a few weeks before the trial started that x-ray evidence demonstrated that Baby C had been fatally injured on 12 June, 2015, when air was injected into his stomach via a nasogastric tube.

Suggested reading
The flaws in the Lucy Letby case

By Adam King

However, by the time Evans gave evidence, it had emerged that Letby had not been at work on 12 June — prompting him to change his story, and claim she must have administered the fatal injection the following day. Cross-examining Evans, Letby’s barrister, Ben Myers KC, accused him of massaging his evidence to avoid inconvenient truths. Evans said he “disagreed”, and it seems the jury believed him.

Yet concealed altogether from the trial was Evans’s account to police in October 2017. Then, Moore’s notes say, he thought the critical event was the discovery at 7am on 12 June that Baby C’s “UV line” — an umbilical catheter used to administer fluids and medicine to sick newborn babies — had “come out”. “Can this be explained?” Evans asked. “If the UV line being out is suspicious, then death is suspicious.” Again, there was no mention of the fact that Letby was not on duty on 12 June. In fact, she had not been at work at all since the baby’s birth on 10 June.

It’s a similar story with the case of “Baby I” who, according to Evans at the trial, Letby murdered by injecting air into her bloodstream on 22 October 2015. But in 2017, he told the police about an earlier “suspicious” incident, when Baby I went into respiratory arrest at 10pm on 30 September and began to struggle to breathe. Her abdomen was “distended”, Evans said in his initial report to police, suggesting she had been attacked with “air into stomach”, which might have been injected through her “milk line”. The jury did hear that her condition worsened that night, but no evidence that this was Letby’s fault. After all, her roster record makes clear she was not at work that night.

And then there’s the death of Baby O — the case that persuaded Evans that there was a murderer at the Countess of Chester within 10 minutes of starting to review the hospital’s medical records he was shown by police. At the trial, the jury was told Baby O had been “stable” until the afternoon of 23 June 2016, when he suffered a “remarkable deterioration”. But when Evans met the police in 2017, he said there were already “problems before collapse”, and that by 5am, his heart rate was “climbing” — a sure sign he was not in good health. This was, he concluded, “suspicious”, and what had happened “overnight 22–23 [June]” was “relevant”.

He may well have been correct. But on the night in question, Letby was not at work. Indeed, last month, MP David Davis revealed in Parliament that an assessment of Baby O’s medical notes by two eminent neonatal consultants had found that the “impact injury” to her liver that triggered severe internal bleeding was inflicted not by Letby but by a consultant pediatrician, who inadvertently stabbed the organ with a needle. The same doctor, Davis said, went on to become one of Letby’s principal accusers, and gave evidence at her trial.

“But on the night in question, Letby was not at work.”

Suffice it to say that none of this featured during Letby’s trial — though other doubts about Evans did surface. It emerged, for instance, that the Court of Appeal’s Lord Justice Jackson had taken the extraordinary step of writing to the trial judge, Mr Justice Goss, detailing how a report drawn up by Evans in an unrelated family case had been dismissed as “worthless”. Evans, he claimed, had breached his duty as an expert by deciding on the outcome he wanted, then “working out an explanation” to achieve it. “Of greatest concern”, Jackson wrote, “Dr Evans makes no effort to provide a balanced opinion,” suggesting this might amount to “a breach of proper professional conduct”.

This warning was not taken lightly. I have seen a further unpublished document that suggests that Jackson’s email to the judge produced alarm in the prosecution camp. It shows that on 9 January 2023, Crown Prosecution Service lawyers held a meeting with Evans in which they posed scripted questions about Jackson’s criticisms. He appeared untroubled, saying: “I stand by my report.”

Next week, a panel of international experts is set to offer further challenges to the prosecution case, and is expected to produce a report based on close analysis of the babies’ records, saying Letby’s “victims” were not deliberately harmed or murdered. Meanwhile, the Court of Appeal has refused her permission to appeal her convictions and found that there could have been “no arguable basis” for excluding the evidence given by Evans from the trial.

As for Evans, in October last year, he submitted yet another report on the babies’ deaths to Cheshire Police — which has, thus far, refused to disclose it to Letby’s new lawyer, Mark McDonald, who is fighting to get the case reopened. Beyond this, Evans is reluctant to be drawn on his initial report. When I put detailed, written questions about the issues raised in this article to Evans, he declined to respond, saying only: “I decided, as of mid-December last year, to make no comment pending the completion of Lady Thirlwall’s [public] Inquiry (summing up in March I understand) and Cheshire Police completing their investigation.”

I also put detailed questions to the Cheshire police but they also declined to answer them. Their spokesperson said the force was still investigating deaths at the Countess of Chester Hospital and at a hospital in Liverpool, adding: “Cheshire Constabulary has declined to be involved in much of the ongoing commentary within the media… There is a significant public interest in the reporting of these matters, however, every story that is published, statement made, or comment posted online that refers to the specific details of a live investigation can impede the course of justice and cause further distress to the families concerned. It is these families and the ongoing investigations that remain our primary focus.”

The late Appeal Court judge Lord Denning once commented that if it were true that the Birmingham Six, the men convicted of killing 21 people by bombing pubs in 1974, were innocent, this would constitute a “an appalling vista” that he found impossible to contemplate. In 1991, fresh evidence made it clear that they were victims of one of the worst miscarriages of justice in English legal history, and they all walked free.

In the wake of her convictions, Letby, like the Six, was portrayed as an evil monster, a woman who fully deserved to rot in prison for the rest of her life. What an appalling vista if she were revealed to be a victim, not a perpetrator.

Drug lords create a climate of fear

Amsterdam

A hit squad compared to a “well-oiled murder machine”. A lawyer and journalist shot on the streets of Amsterdam. A blasé approach to killing the wrong person — there’s even slang for every accidental victim: a vergismoord. Welcome to the Marengo trial, where 17 men stand accused of involvement in six murders, four attempted murders and preparing for six others between 2015 and 2017.

Fear hangs in the air around this court case, telling a tale of a country where the hydra of organised crime has so many heads that it is threatening the very rule of law. When the trial resumed this month, journalists were asked to sign agreements not to name judges or prosecutors, for fear of them being targeted. After reports that co-chief suspect Ridouan Taghi was planning a jailbreak, the streets around the fortified courtroom known as the Bunker are ringed with police cars and trained teams made up of police and soldiers.

The Marengo is only the latest in a series of organised crime trials to shake the Netherlands. This year, Dutch courts are also trying alleged criminal druglord Roger P., accused of turning shipping containers into an underworld prison, with its own gruesome “torture chamber”. Meanwhile, a Marengo side-trial involves motorbike club Caloh Wagoh members charged with shooting dead five people, preparing three other murders and “putting another seven people on the waiting list to be killed”.

“I call The Netherlands a ‘narco-state 2.0’,” says Jan Struijs, chairman of the Nederlandse PolitieBond police union. “We aren’t Mexico, with 14,000 dead bodies, but in our parallel economy, there is an attack on public order and unprecedented numbers of people with personal security — politicians, judges, prosecutors, police staff, journalists — because there is still a serious risk from organised crime. It is a huge problem, being tackled on every front, but we have a long way to go.”

Struijs first raised concerns that this small, well-connected trading nation has “characteristics of a narco-state” four years ago. At the time, there was a muted political response. But then the brother of the Marengo crown witness Nabil B was shot dead and the crown witness’s original lawyer, Dirk Wiersum, was gunned down outside his house. Finally, last July, celebrated crime reporter Peter R de Vries, who had unconventionally agreed to act as Nabil B’s representative, was shot in the head on a busy central Amsterdam street and died of his wounds.

Today, few would argue that increasingly violent crime has clawed its fingers deep into civil society. But as Lieselot Bisschop, criminologist at Erasmus School of Law in Rotterdam, points out, before you can combat the crime, it is important to understand who is involved and how. She and a team of researchers have been looking at the key drug runners’ entry and exit point of Rotterdam port, where last year a Hit and Run Cargo team (HARC) confiscated a record 72,808 kilos of cocaine plus another record of 1,500 kilos of heroin. “Whether it’s a good thing that they are catching more, I don’t know — is more going through anyway?” says Prof Bisschop. “The quantity aspect is always very challenging. It’s a dark number, guesstimates.”

Meanwhile, the Netherlands is apparently a centre of synthetic drug manufacture, with regular busts of “professional” crystal meth and MDMA labs, especially in Noord Brabant. When international police decrypted millions of messages on devices criminals thought were secure — such as Sky and EncroChat, and the Dutch decoded Pretty Good Privacy software for Blackberry’s in the Marengo case — they lit up a web of crime.

Experts agree the Netherlands’s infrastructure is key for both legal and illegal trade. In their 2020 book, Nederland Drugsland, Dutch police academy professor Pieter Tops and journalist Jan Tromp explored how criminals exploit its efficient ports, good roads, and strong financial and digital infrastructure. “The Netherlands has long been a trading country — not just the harbours but also our high-quality internet environment. We have huge numbers of bankers and our country is central in Europe in terms of all kinds of transport and transit,” says Struijs. “We have huge numbers of imports, which means a lot of drugs are mixed with legal trade, coming in containers of fruit or liquor. Organised crime takes advantage of the legal infrastructure.”

Corruption is another factor. As a nation, the Dutch are keen to make a deal — and regular businesses haven’t always been too fussy about carrying out background checks, as various banking money laundering cases and high tax haven rankings show. The NVB Dutch banking association says an estimated €16 billion in illegally-earned cash washes around each year.

Personal corruption is also a problem in a port 40km long and with 180,000 employees, says Bisschop. “Within Europe, it is definitely the gateway for any kind of trade and probably for cocaine. Over the years, the port has become more physically and digitally secure. We think this has contributed to more pressure on the people in the port. Basically, you need corruption to pull it off — both public and private, not just police and customs but also planners in container terminals. You need someone on the inside.”

So in court, says veteran crime reporter Saskia Belleman, there has been a spate of cases against allegedly corrupt customs staff, shipping and port employees, partly as a consequence of a Dutch gedoogcultuur of looking the other way. There are also concerns about so-called “collectors”, often young men who trespass into the harbour and collect drugs.

Nobody knows if the Netherlands is worse than other European port countries in terms of international organised crime, but its soft drug culture is undoubtedly a weak spot. Although smoking cannabis and coffee shops selling the drug are tolerated, it is illegal to grow commercially. This means that cafes offer a legally tolerated channel for criminal activity, and a training ground for young criminals.

More from this author
Why Rotterdam erupted

By Senay Boztas

In the Netherlands, it’s become increasingly common to read about the ethnic aspect of organised crime — the so-called “Mocro Maffia” Moroccan-origin mafia which inspired a true crime book and spin-off television series. But Peter Schouten, one of the new lawyers for the crown witness in the Marengo trial, says: “It’s not true that it’s only people with another ‘heritage’. Certain gangs have a kind of micro-organism, a gangland where there’s a lot of the same culture, but there are other gangs arrested, and you read stories saying that the new kingpin is ‘Bolle’ Jos from Brabant.”

It’s hard to measure organised crime, partly because victims don’t always make reports, but ethnic minorities are overrepresented as crime suspects. Statistics Netherlands researcher Maarten Bloem says, though, that “if you correct for age, education level, socio-economic category, there is not much difference between different ethnic origins”. He concludes: “It’s not so much about someone’s colour but the situation in which they find themselves.”

It is unclear whether the segregated, Dutch grammar school system helps contribute to excluding certain groups, too: critics say it selects too young, hammers in socio-economic difference, and makes no account for innately-talented children who speak Dutch as an additional language.

Crime, after all, can be seen as a way out of poverty and an equal opportunities recruiter. So there’s a widespread recognition that long-term crime prevention needs to offer other options, especially to young men in problem districts. There’s a new drive targeting “vulnerable” areas in Utrecht, and projects such as working with the “top 600″ criminals and their families in Amsterdam. Meanwhile, international efforts have been led by the mayors of Rotterdam and Belgian Antwerp — where a record 90 tonnes of smuggled cocaine was found last year. They have visited South American counterparts and lobbied governments to ramp up international efforts against organised crime, increase barriers in harbours, and confiscate criminal assets.

In Rotterdam, there are promising signs of public-private cooperation, with busts by the multi-agency HARC, a new Information Sharing Centre, a business integrity initiative, and a “training container” to coach harbour staff in combatting corruption. A long-awaited law banning civilians from the container area is in place to help apprehend those vital ‘collectors’ picking up drugs from containers, while Rotterdam mayor Ahmed Aboutaleb is also enforcing a €2,250 anti-nuisance penalty. The new Dutch coalition hopes to add to these initiatives. It will start investing specifically in combating crime that “undermines” public order from 2023, ratcheting up to a €100m yearly investment by 2025. In the meantime, the last budget put aside an extra €434m to increase annual budgets for police, judicial organisation and subversive crime prevention, though experts warn that money must not be used to add to the layers of bureaucracy.

Suggested reading
Why Rotterdam erupted

By Leighton Woodhouse

Instead, some want a shift in public attitudes on drug taking: as the prosecutor said in the torture container trial, show users the “abhorrent” consequence of their habits rather than perpetuating the permissive, hippy culture of the Seventies. “It’s not done in the Netherlands to point in the direction of drug users,” says Belleman. “If you don’t use drugs, there’s no market. But people who use cocaine at the weekends don’t make the connection between organised crime and their drug use — and if you tell them, they are really offended.”

Perhaps the biggest problem, however, lies in how to prosecute those alleged criminals who are caught. In the mega-Marengo trial, hearings are currently mired in details such as whether the co-chief suspect Saïd Razzouki left his reading glasses behind when he was extradited from Colombia in December, and whether due process was followed in his subpoena.

The accused in the trial deny the charges, and Schouten doesn’t expect a verdict until 2023. “This trial is under an enormous amount of pressure,” he says. “This is about the rule of law, the dyke against injustice, and we must continue to protect this. But there is a lot of fear.” Even when the trial verdict is reached, until words turn to action, that fear is unlikely to go away.

She tried to destroy her accusers to save herself

Always young, always blonde. In this story the girls are a selected type, not human beings. They had loose lives that rattled like spare change. Easily discarded, easily lost. Most of these girls had nothing at all, and even that would be taken from them.

They’ll be sitting outside the school gates, or in the resort where they are doing holiday work, or on a bench at a summer camp. Head down in a book. They want to be singers, or anything to get away from home.

The approach is made by a couple, or by an older woman on her own. Jeffrey Epstein and Ghislaine Maxwell: friendly, worldly, wealthy. Ghislaine is armoured with a classy accent, a Yorkshire terrier, and expensive clothes. She plunges into their lives. One of the accusers did not “have the reading ability” to say Maxwell’s first name. But forget that. Ghislaine wants to play the giggly older sister; pal and confidante.

The accusers’ testimony suggests that Ghislaine seemed young in herself. She offered wooing gifts: preppy shirts, loafers, Victoria’s Secret underwear, cashmere sweaters. They become friends with her in malls and cinemas. Their ages when Ghislaine allegedly facilitated, and occasionally participated in, Epstein’s sexual abuse of them, were: fourteen, fourteen, sixteen and seventeen. Jane, Carolyn, Annie, and Kate.

Ghislaine Maxwell was from a different universe. The question of her trial was whether she, like the girls, is a victim of Jeffrey Epstein too. Ghislaine, daughter of the publishing tycoon Robert Maxwell, and variously described as Epstein’s girlfriend, madam, employee, best friend, pimp, and general, was arrested in 2020. She was accused by the US government of gathering up Jane, Kate, Carolyn, and Anne over a decade, like a beachcomber, and delivering them to Epstein.

More from this author
Power is corrupting the Tories

By Will Lloyd

For four weeks, the trial in lower Manhattan has been watched with awe. Outside the courthouse stand placards and protestors and paranoiacs. Three overflow rooms inside contain the world’s press, concerned private citizens, and podcasters. They are drawn there for irresistibly tabloid reasons: the downfall of rich people in heavenly places who did evil things.

Epstein and Maxwell were high society floaters, who bobbed unflushably in transatlantic streams, fishing for famous friends. (Taki says she was “not a bad girl” — I suppose we’ll have to take his word for it.) By the time Epstein earned his first conviction for sex crimes in 2008, the couple had collected an entire Met Gala of chintzy brilliancies: actors, publishers, royals, writers, scientists, academics, and politicians. That constellation has blinded many to the couple’s more gothic collection of broken young women. Why care about them, when they are landmines lying in wait for Prince Andrew, Ariana Huffington, Geordie Greig, Donald Trump and Bill Clinton?

These embarrassing links, the dozens of embarrassing photos that accompanied them, and the embarrassing circumstances surrounding his death, transformed Epstein. In the world’s imagination he was no longer a rich bullshit artist and an abuser. He became a popular demon, a supervillain, a Halloween costume. Writers polished their 24 Carat allusions: Epstein was Machiavelli, he was Mephistopheles. He was the ultraviolet scan that illuminated a rotten system of perversion and power. Maxwell’s trial was widely considered to be the last chance at justice for many of the women who claim to have been abused by Epstein.

But Epstein is dead. This was Ghislaine’s trial, and throughout she has been circumspect, almost dignified, and given nothing away. Videos outside the courthouse showed her old and arthritic and beaten down. She does not look like she will ever adjust to thinking of herself as a dangerous criminal. She appeared tired of being herself. Sooner or later, compassion was bound to be felt for the accused. It’s only natural. Old university acquaintances suggested they felt pity for her. Friends anonymously briefed glossy magazines, and said they could never imagine her scoring trailer trash by skulking around outside public schools. It just wasn’t her style, darling. None of them ever took the stand to defend her though. That just wasn’t their style.

These disposable, costless emotions were a perfect echo of the defence put up by Maxwell’s attorneys. They said she had become a bullseye for the limitless greed, pointless anger, and false memories of the accusers. Maxwell was the real victim here. This was whiplash; an acidic backwash from Epstein’s death that mistakenly threatened to dissolve their client, because he could never stand trial. Eternal archetypes were invoked. “Ever since Eve was tempting Adam with the apple,” said one Maxwell lawyer, “women have been blamed for the bad behaviour of men”.

The men were Epstein, and at a more distant remove, Robert Maxwell. To believe in the defence, you had to believe that Ghislaine had been without a sense of her own interest for decades. That she was helplessly shaped by these amoral patriarchs. Her father and Epstein were eerily similar, if not the same man. Both escaped obscurity and exchanged it for wealth. Both courted ‘brilliant scientific minds’ with praise and parties. Both were talented at exploiting the weaknesses of rivals they destroyed on their way up. “You’re talking about a sociopath,” said Steven Hoffenberg, Epstein’s former business partner. “Every component of his existence was the destruction of other people.” Hoffenberg might have been describing Maxwell.

How much of their behaviour was for show, and how much was real, and whether they knew the difference, was unclear. A bewildering aura of fantasy surrounds them. They had a curious shared interest in the Marquis de Sade, and they inhabited airlessly Sadean worlds of selfishness, injustice, and misery. In de Sade’s pages nobody ever changes. His characters are glazed and flat; moral development is an impossibility. As one of the libertine monks in Justine, or The Misfortunes of Virtue (1791) — a novel Epstein displayed in his home and proudly showed off to a journalist — rhetorically asks: “Can we become anything other than we are?”

Maxwell and Epstein answered that question with an emphatic no. They would forever be outsiders who shredded convention, determined to consume whatever and whoever they found once on the inside. Each was regarded with a mixture of dread, sarcasm, and awe. Their most credulous, generous supporters came from the top. Epstein, as Maxwell did the British establishment of his time, regarded them with contempt. He once told his brother that if the public knew how corrupt his Wall Street friends were, there would be a revolution.

Above all these men lied, unstoppably and uncontrollably. They lied to business associates, mistresses, journalists, judges, creditors, and lawyers. They lied about money to make more money. Their skill was faking and lying uncommonly well enough to create new, unstable realities. Their lies became eight-storey yachts and the largest townhouse in Manhattan. Every new acquisition was honeycombed with surveillance equipment; recording devices and teeny tiny cameras. This is usually considered further evidence of these men’s perfidy. Blackmail gatherers, Epstein and Maxwell, working on another sick angle, preparing a new front in their war on everyone they ever met. But they were not spying on their guests.

The evidence that Epstein blackmailed his friends is thin, and has fallen apart before. Maxwell used his devices to track a secretary who didn’t love him around London, as she slept with one of his underlings. They surveilled their environments because all their lies made their environments, and themselves, insecure. Each was one or two discoveries away from the collapse of their entire world. The footage and the recordings were not made for blackmail. It was a form of consolation. It proved that for all their lies, they were still real. One of Epstein’s homes was lined with framed glass eyeballs made for injured English soldiers from a deadlier century. The display was a warning to his guests, and a reminder to himself: watch your every move.

Are we supposed to paint Ghislaine Maxwell on this bleak canvas as the feckless girl next door? A crass ingénue, an Eve who didn’t know any better? It is closer to the truth to say that both men needed her as much as she needed them.

Maxwell family legend has it that Ghislaine was anorexic as a very young child. She was probably abused by her father, as he was by his, when she was an adolescent, with riding crops and shoe horns. But by the time she arrived, fully formed and totally integrated, at Oxford during its woozy Brideshead revival years in the early Eighties, Ghislaine’s dramas of individuation were over.

She was ahead of the pack, imperious from the off. She spoke five languages and was the director of a football club. The beautiful “glamazon” rested a boot on Boris Johnson and parties with Gottfried von Bismarck. She was inadvertently to blame for the creation of George Monbiot. Her father kept one photo of his nine children on his desk — a portrait of Ghislaine. As his mania grew and his business empire fell apart in the later Eighties, she remained good, pure, true. His colleagues thought him “pre-moral”, disconcerting, disgusting, and frightening. And he was fond of saying “I have a beautiful daughter who is just like me.”

Suggested reading
Robert Maxwell was no mystery

By Tanya Gold

Ghislaine was already in New York when her father died in 1991. Supposedly adrift, grieving, and broke, the conventional narrative has Epstein performing a bat-like swoop and winging Ghislaine off into his cave. “He saved her,” one Maxwell friend told Vanity Fair, “Jeffrey took her in. She’s never forgotten that, and never will.” In this telling Ghislaine is another picked-up, pitiable woman, ensnared by a master manipulator. Whatever crimes she involved herself in later could almost be excused. They were payments for a debt.

All you have to do to believe that is forget she was Robert Maxwell’s daughter. She had a glittering upbringing. She was skilled at getting what she wanted, at reeling people in, at throwing parties. Epstein was cash rich but class poor. Described in these early years so often as a “schlub”, he needed a charismatic partner to launch his conquest of Manhattan’s charity auction set. Otherwise he was just another nerdy dogsbody who helped plutocrats avoid paying tax. Every bank in the city had a thousand of those.

Ghislaine helped propel his somersault into the ranks of the super wealthy. He valued her as his equal: “Ghislaine is the best at what I need,” he said in 2002. “Ghislaine speaks five languages fluently… She’ll come to a meeting, and not only will she be able to translate what the person’s saying… but she can also give me a sense of is the person telling the truth.” All she received in return were private jets, lavish estates, and vast sums of money.

This world melted away, like her father’s did. The trial came long after the deluge. It was mind-numbing. There were endless examinations of flight logs, property portfolios, and financial transactions. The accusers were tortured on the stand by Maxwell’s lawyers. To save their Eve, they had to destroy the credibility of four others. The women sobbed; it sounded like the air around them was being eaten by the sadness they felt. We learned that post-Epstein, Carolyn went on to become a drug addict, prostitute, and single mother. Facing Maxwell a few weeks ago, she pointed at her and shouted: “You broke my soul.”

If Ghislaine still had a soul it was well hidden in the courtroom. You had to look for it elsewhere. The dozen pictures of her and Epstein released during the trial are a good place to start. She has the same face in every photo. A greying man and his partner, affluent and easy, sitting in a grass field with a dog; as perfectly self-possessed and unreal as a couple in a Ralph Lauren catalogue.

This was the only reveal from the trial. There were no big prizes, no doomily grim revelations about paedophile rings operating at high altitude, among the jet set, that the placards outside the courthouse prayed for. The apocalypse never arrived because the apocalypse had already happened: it was the afterlife of the four accusers. There was no final answer to the mystery of Epstein’s death. Only the look Maxwell gives him in each image, taken over the span of their eleven-year relationship. Love. Nothing could be guiltier.

The scars of the past years are unlikely to heal

As a matter of justice, Kyle Rittenhouse deserved to be acquitted. Despite the jury taking three-and-a-half agonising days to deliberate, his case was relatively straightforward and none of the facts were seriously in dispute.

He went to Kenosha, Wisconsin, last August to protect property during a Black Lives Matter protest after widespread arson and vandalism the night before. He ended up shooting three men that night, killing two, in what he claimed were acts of self-defence. All of the shootings were captured on video, some from multiple angles. He tried to retreat from everyone he shot that night, resorting to deadly force only when he was cornered, physically attacked, or threatened with a gun. At no point did he continue shooting after ending the immediate threat.

Although prosecutors attempted to argue that, merely by being present with a gun, Rittenhouse, now 18, had “provoked” the protesters, they were unable to provide any convincing evidence that Rittenhouse had done anything to threaten anyone or initiate conflict in any way. The defence, by contrast, was able to show that Rittenhouse, far from picking fights, attempted throughout the night to avoid or defuse conflicts with protesters.

The trial confirmed that the real villain of the night was the first man Rittenhouse shot, 36-year-old Joseph Rosenbaum. This was the most important shooting, because it set in motion the events that led a crowd to assault a fleeing Rittenhouse, allegedly in the belief that he was an “active shooter”, and which led to Rittenhouse shooting and killing Anthony Huber, who was attacking him with a skateboard, and wounding Gaige Grosskreutz, who advanced on Rittenhouse with a drawn pistol.

Suggested reading
Would America survive a civil war?

By Malcom Kyeyune

Rosenbaum, a convicted child-rapist and domestic abuser, had no connection to the protesters. He was a disturbed man who had been released from a psychiatric ward earlier in the day and who, according to video evidence and multiple eyewitness testimony, had been belligerent and threatening all night.

According to both Rittenhouse and one of his companions, the Army veteran Ryan Balch, Rosenbaum told members of their group: “If I catch any of you guys alone tonight, I’m going to fucking kill you.” Later in the evening, he found Rittenhouse alone and began chasing him across a parking lot. After first attempting to run away, Rittenhouse wheeled around and shot the advancing Rosenbaum. The closest eyewitness to the shooting testified that as Rosenbaum approached the defendant, he yelled “fuck you!” and lunged for the barrel of Rittenhouse’s gun. The other main clarification at trial came from Grosskreutz, who admitted that Rittenhouse only shot him after he pointed his own gun at the teenager.

Many of the initial media reports that painted Rittenhouse in a sinister light turned out to be false — for instance, Grosskreutz’s claim, which he repeated in multiple interviews, that he had been shot with his hands up in a position of surrender. Rittenhouse did, as was reported early on, “cross state lines” to get to the protest, but only from Antioch, Illinois, a border town that is a suburb of Kenosha, which is where Rittenhouse worked and where many of his family live. He did not transport the gun across the border, and although it is legally murky whether he was allowed to be carrying it — he was 17 at the time — the judge threw out the charge because of ambiguities in the law.

Yes, he was a supporter of Trump and Blue Lives Matter, but there is no evidence that he was a “white supremacist,” as alleged by Congresswoman Ayanna Pressley, or a “domestic terrorist,” as alleged by Pressley and Ilhan Omar. He was not a member of any militia group, despite the misguided representations of his initial defence team. He was not out “hunting” anyone.

The most damning evidence against him, which was not admitted at trial, was a video from a few weeks prior in which he joked about shooting looters. But again, there was no credible evidence that he initiated or escalated conflict with anyone that night. He lied about being an Emergency Medical Technician (EMT), when in fact he had only received CPR training, but this was hardly relevant to the shootings. Perhaps he shouldn’t have been there, but the same was true of nearly everyone there that night. They were all defying a curfew. Many of the protesters were also from out of town. Some, like Grosskreutz, were also carrying illegal guns.

From the beginning, the case against Rittenhouse relied on obfuscating the actual events of the night in favour of mythmaking: easily debunked misinformation, moral and emotional appeals to the justice of the protester’s cause, the racial identity and political sympathies of Rittenhouse, the far-Right politics of some of his most vocal supporters, rhetorical flights against “white male tears” or “fascism”, and arguments about the United States’s gun laws or the biases of its criminal justice system. One index of the confusion surrounding the case is the number of Twitter users who appear to have only recently learned that Rittenhouse’s assailants were white.

Indeed, even on the Left, those reporting on the case or following it closely have tended to conclude that Rittenhouse was not the monster he was initially painted as. Long pieces in the New York Times Magazine and the New Yorker, while drawing attention to the extremism of some of the militia members who showed up to protests, to the general atmosphere of chaos, violence, and racial tension that summer, and to the role of Right-wing media in stoking outrage over rioting and property destruction, concluded that Rittenhouse himself was more or less a foolish kid with conventional politics who got in over his head. Last week, Ryan Grim of The Intercept tweeted: “People should be prepared for Rittenhouse to be acquitted on all the major charges”.

Emotional reactions, not to say irresponsible tantrums, are to be expected after a divisive trial such as this one. Commentators on both sides will say stupid things, and there will be no shortage of people on Twitter making triumphant racist memes about Rittenhouse or declaring that the verdict gives licence to MAGA wingnuts to hunt down liberals and shoot them for sport. Today, nearly every national issue in the United States is what the blogger Scott Alexander has called a “scissor” issue — one that is not merely divisive but in which the opposing sides seem to be operating in different planes of reality. The Rittenhouse verdict is no different, even if in this case, unlike in the Brett Kavanaugh or Covington Catholic controversies, we can know with reasonable certainty what actually happened.

What happens next will be a litmus test for the country. Despite the uncertainties inherent in jury trials, the two main trials to come out of last summer’s unrest, this one and the murder trial of Minneapolis police officer Derek Chauvin, reached the correct verdict, though this is cold comfort in a country where the two main factions are defined by their mutual mistrust and loathing. Already, Republicans have begun pouring salt into the wound, and it looks as if the verdict will cement Rittenhouse’s reputation as a conservative folk hero — an innocent man smeared by corrupt politicians, a partisan media, and biased Big Tech companies.

Democrats, meanwhile, are convinced against all evidence that a cold-blooded murderer has been set free due to the colour of his skin, with leading politicians declaring the verdict a “miscarriage of justice” and asking the Justice Department to pursue what could only be described as a political prosecution of the Wisconsin teen. These are signs that the scars opened over the past few years will not be quick to heal.

Yet some on the Left have already begun to signal that things got out of hand last summer. They are admitting, for instance, that “defund the police” was a stupid and politically toxic idea, that riots and arson lead predictably to violent chaos and should therefore be discouraged rather than cheered, and that some of the police shootings that initially sparked outrage — including the one that set off the riots in Kenosha — were based on initial reporting that, had it come from Fox News or the Right-wing Twittersphere, would have been clearly labelled as disinformation.

Many of these things were obvious at the time, and it can be frustrating now to observe those who only found the courage to say the obvious after Joe Biden won the presidency. But it is better than the alternative, which is to continue denying the reality in front of their faces. In this case, the reality is that Rittenhouse was found innocent of murder, and correctly so. Biden, to his credit, has already stated that “the jury system works and we have to abide by it”. One hopes that his allies will listen. To refuse to do so is only to court more tragedies.
